By using this website, you agree to these terms of use. If you do not agree to these terms, you may not use this site. Zimmer Stewart Gallery reserves the right, at any time, to modify, alter, or update these Terms of Use, and you agree to be bound by such modifications, alterations, or updates. No person under the age of 18 years can purchase goods from our online shop.

Governing Law

Your use of this website and any purchase by you on this website or from the gallery will be governed by English Law and will be deemed to have occurred in the United Kingdom.

As Data Controller for the purposes of the General Data Protection Regulation (GDPR) Zimmer Stewart Gallery is firmly committed to respecting your privacy.

We DO NOT share your details with any third party. You will only receive emails from Zimmer Stewart gallery with a periodic newsletter on new exhibitions and artist updates. We no longer send out direct mail by post. Additionally we also send out Private View Invitations via email 6-8 times per year.

Our current Data Processor for Email Marketing is Mailchimp. You can unsubscribe yourself at any time from our mailing list by sending an email to info@zimmerstewart.co.uk, or by clicking the link at the bottom of any email newsletter from us. You can choose whether to receive email marketing from us, and can update your preferences and/or contact details or unsubscribe at any time using the link at the bottom of each newsletter sent out.

Further we do not store your financial information. We only use information in accordance with the Data Protection Act 1998.

You also have the right to access the information we hold about you.

Order Acceptance

The receipt by Zimmer Stewart Gallery of an email/online order confirmation does not constitute the acceptance of an order or a confirmation of an offer to sell. The Company reserves the right, without prior notification, to limit the order quantity on any editions, or other goods on our online shop and/or refuse service to any customer. See also our Pricing Policy below. Once an order confirmation is received by us, we will contact you to arrange payment and delivery/collection, no contract for sale exists until this has taken place. All orders received are subject to availability of art works at the time of receipt of order. Acceptance of orders by Zimmer Stewart Gallery are subject to clearance of funds and where applicable authorisation of debit and/or credit card details. All sales will be made in British pounds sterling.

Shipping

We can ship both gallery and online sales to any UK or international address. Please allow 14 business days for us to process, pack and ship your unframed edition, and 28 days for framed prints and sculptural editions. Although, we do usually try to get despatches out quicker than this. For international deliveries we will quote a price for this which will be added to the sale price of the goods being sent.

Returns

We offer a 14-day, money-back guarantee if you are not happy with your online purchase, or if sent to you and it arrives damaged in any way. RETURNS MUST BE MADE IN ORIGINAL PACKAGING. Returns must be made at the customers expense including both cost of return and insurance. In the case of damaged goods the gallery must be notified within three days of receipt in writing (via email).

Changes to online Prices

Prices quoted on our online shop are subject to change. As is normal in edition sales, prices can rise as the edition begins to sell out. We do try to keep the prices accurate on the website, but in case of any updates you will be notified before your order is processed.

Cookies
Like many websites we use cookies to store and then retrieve small bits of information on your computer when you visit. This information is used to make the site work as you expect it to. It is not personally identifiable to you, but it can be used to give you a more personalised web experience.

Some of the information stored is put there by other companies whose software we have added to the site, and this can also impact your experience of other websites you may visit after leaving ours.

You understand and agree that the Zimmer Stewart Gallery shall not be liable for any direct, indirect, incidental, consequential or exemplary damages, including but not limited to, damages for loss of profits, data or other intangible losses (even if the owner of this site have been advised of the possibility of such damages), resulting from the use or the inability to use the product(s) and or service(s) or any misuse of the product(s) and or service(s) in a manner not in accordance with their intended use.

Dispute Resolution

In the event of a dispute arising out of or in connection with these terms or any contract between you and us, then you agree to attempt to settle the dispute by engaging in good faith with us in a process of mediation before commencing arbitration or litigation.

Anti-Money Laundering
Under the terms of the anti-money laundering regulation effective from 10 January 2020 we are required to conduct customer due diligence (CDD) on all sales of works of art over €10,000 before the transaction is carried out. While therefore we may agree such a sale in principle, we will not be able to conclude (i.e. receive funds, give up possession or transfer title) it until we have received all the necessary CDD information from you and have been able to verify it as required by the regulation.

For individual buyers, we are required, by law, to verify the buyer's full name, date of birth, nationality, and permanent address; we will need to see, and take a copy of, a valid government-issued photo ID such as a passport, driving licence or national ID card.

If the artwork is purchased on behalf of a company, we will need to have company details including evidence of incorporation, directors, and any ultimate beneficial owners.

The information you provide will be held and processed by us in accordance with Data Protection Regulations and will remain confidential. We thank you for your understanding of why this is necessary and will ensure that the gathering of this information is handled as speedily as possible.

Force majeure

We are not liable for any breach of our obligations resulting from causes beyond our reasonable control.

VAT

Zimmer Stewart Gallery is currently not VAT registered.
